Crippling Compensation in the Law of State Responsibility

On the 21 June 2021, Prof. Martins Paparinskis (University College London) gave a lecture, followed by a discussion by Prof. Anne van Aaken (University of Hamburg), on Crippling Compensation in the Law of State Responsibility.

This lecture concerned compensation in the context of the Law of State Responsibility for internationally wrongful acts.

The obligation of States to provide full reparation for internationally wrongful acts, including by full compensation, is one of the bedrock principles of international law.

In his lecture, Prof. Paparinskis challenged this principle for cases where compensation is crippling for the responsible State or its peoples.

This can occur when State responsibility is implemented before international courts and tribunals. His argumentation was discussed by Prof. Anne van Aaken.
